1. SERVICES
Photographer agrees to provide real estate photography, videography, and/or aerial drone media services as requested and scheduled by Client.
Services may include, but are not limited to:
Interior and exterior real estate photography
Aerial drone photography and/or video
Walkthrough video
Social media clips
Twilight photography
Marketing media related to a property listing
Specific services and pricing are confirmed via invoice, booking confirmation, or written communication and are incorporated into this Agreement.
2. PAYMENT
Payment is due as outlined in the invoice or booking confirmation. A 50% non-refundable deposit is due upon booking. Final payment is due the day of the photoshoot outlined in this contract.
Photographer reserves the right to withhold delivery of images and media until full payment has been received.
Late payments may incur fees at the 30 days.
3. CANCELLATION & RESCHEDULING
Client agrees to provide reasonable notice for cancellations or rescheduling.
Photographer reserves the right to charge a cancellation or rescheduling fee for appointments canceled within 24 hours of the scheduled session.
Weather-related rescheduling, including unsafe drone conditions, will be accommodated at Photographer’s discretion.
4. DRONE OPERATIONS
Photographer operates in compliance with applicable FAA regulations and will not conduct drone operations in restricted or unsafe airspace.
Drone services are subject to:
If aerial services cannot be performed safely or legally, Photographer may reschedule or substitute alternate elevated images.
5. PROPERTY READINESS
Client is responsible for ensuring the property is prepared, staged, and ready at the scheduled time.
Photographer is not responsible for cleaning, staging, or moving items.
If the property is not ready, Photographer may proceed as-is or reschedule at additional cost.
6. DELIVERY
Final edited media will be delivered digitally within a reasonable timeframe, typically within several business days unless otherwise stated.
Delivery timelines may vary based on scope of services and workload.
Additional edits beyond standard correction may incur additional fees.
7. COPYRIGHT & LICENSE
All photographs, video, and media remain the sole intellectual property of Photographer.
Upon full payment, Client is granted a limited, non-exclusive, non-transferable license to use the media for:
Marketing and sale or lease of the property
MLS listings
All Real estate marketing platforms
Social media related to the listing
Media may not be:
Sold or transferred to third parties
Used by another agent without written permission
Used for long-term commercial branding unrelated to the listing
Altered beyond basic cropping or resizing
If a property is re-listed with another agent, a new license contract must be obtained.
8. COMMERCIAL OR BUILDER USE
Any use of media beyond listing promotion — including builder portfolios, architectural marketing, paid advertising, or commercial branding — requires separate written licensing agreement.
9. LIMITATION OF LIABILITY
Photographer’s total liability for any claim arising from this Agreement shall not exceed the amount paid for services.
Photographer is not liable for:
Platform compression (MLS, Zillow, etc.)
Market performance of the listing
Missed sales opportunities
Weather or lighting conditions outside of Photographers control.
Regulatory flight restrictions
10. INDEMNIFICATION
Client agrees to indemnify and hold harmless Photographer against any claims arising from:
Lack of property owner consent
Unauthorized access to property
Injury occurring during the session
Drone permission disputes
11. PORTFOLIO USE
Photographer retains the right to use media for portfolio, website, social media, and promotional purposes unless Client requests in writing otherwise prior to the session.
12. FORCE MAJEURE
Photographer shall not be held liable for failure to perform due to events beyond reasonable control, including but not limited to weather, illness, harrassment or safety concerns at the property, equipment failure, or government restrictions.
13. ENTIRE AGREEMENT
This Agreement represents the entire understanding between the Parties and supersedes any prior discussions.
By signing below, Client acknowledges they have read, understood, and agree to these terms.
